Following the February 2026 legal judgement: Raeshaw Farms Limited v Scottish Ministers and Energiekontor UK Ltd [2026] CSIH 10, which confirmed that consideration must be given as to whether grid connection infrastructure associated with a given renewable energy development should be treated as a single ‘project’ for the purposes of EIA, the Energy Consents Unit (ECU) issued a formal Regulation 19 request under the EIA Regulations requiring the submission of Additional Information (AI) to consider the potential for significant environmental effects arising from:
the proposed grid connection by itself (the Proposed Grid Connection);
the proposed Greenburn Wind Park (the Proposed Varied Development) and the Proposed Grid Connection in combination (the Combined EIA Project); and
the Combined EIA Project cumulatively with other wind and grid developments.
An Additional Information (AI) Report has been prepared in response to the Regulation 19 request which presents a proportionate assessment of the potential for any significant effects arising in these three scenarios.
The AI Report should be read as an addendum to the EIA Report submitted with the Section 36C variation application for Greenburn Wind Park. The EIA Report is available to view via this website.
Following feedback from Historic Environment Scotland (HES), REG Greenburn Ltd has agreed to retain two turbines at their consented blade tip heights. A total of 14 turbines are proposed – 11 turbines up to 180 m blade tip height, one at 167.5 m and two at 149.9 m. This agreed design change is reflected in the visualisations presented in the AI Report (Figures AI 6.5 to AI 6.9).
Any new representations on the AI can be submitted to the ECU via www.energyconsents.scot, using the application reference number ECU00005183.
Written representations can also be submitted by post to the Scottish Government, Energy Consents Unit, 4th Floor, 5 Atlantic Quay, 150 Broomielaw, Glasgow, G2 8LU, identifying the proposal and specifying the grounds for representation. They should be dated and state the name (in block capitals) and full postal address of the person(s) making the representation(s).
Any new representations should be received not later than 24th August 2026, although Ministers may consider representations received after this date.
